/ Refunds - Gulf One Design reserves the right to cancel any account at any time without notice for any reason Gulf One Design deems appropriate. Hosting fees will be refunded (prorated for the remaining term).
The following are not prorated or refundable: domain name registration or
renewal fees; or special scripts and software installed for the clients use.
Billing prices and policies - Gulf One Design reserves the right to change billing prices and policies at any time without notice.
Spam
- Gulf One Design reserves
the right to cancel any account that sends spam. Spam includes, but not limited
to, sending unsolicited email originating from Gulf One Design's servers. Using
an email address hosted on our servers in an unsolicited email, or referencing
material hosted on Gulf One Design's server in an unsolicited email. We reserves
the right to delete violating accounts and we shall be the sole arbiter in
determining violations of this provision.

Gulf One Design may change this agreement at any time with or without notification to you. You agree to the terms and conditions posted on the Gulf One Design website and that they can change at any time. You agree that Gulf One Design will not be held liable for any damages incurred from changes to this document.
Termination
You agree that Gulf One Design may terminate any of its services for any reason Gulf One Design deems appropriate. Hosting fees will be refunded (prorated for the remaining term).

Limitation of Liability and Indemnity
You agree that Gulf One Design is also NOT liable beyond the refund of your current term's charges if your website is temporarily unavailable due to errors, hardware failure, upgrades, power outages, backbone interruptions, line interruptions, or any problems that could cause the website to be unavailable.
You agree that Gulf One Design
will NOT BE HELD LIABLE for any profit loss, loss of wages, loss of employees,
loss of employment, direct or indirect mental or physical damages, mental
distress, loss of property, loss of assets, loss of money, incurred fees from an
attorney or other service due to or arising from
Gulf One Design
products or services.
You agree to defend and indemnify
Gulf One Design
and hold
Gulf One Design
harmless from and against any and all claims, proceedings, damages, injuries,
liabilities, losses, costs and expenses (including reasonable attorneys fees)
made by any third party due to the material published on your website.
Arbitration
This Agreement is governed by Florida law without regard to conflict of law provisions. Any controversy or claim arising out of or relating to this agreement, or the breach thereof, shall be settled by arbitration. Any such arbitration will be governed by Florida law and will be held in Escambia County Florida. The arbitrator will be an expert in the field of Internet services. The arbitrator's award shall be final and binding and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
Entire Agreement
It is expressly understood that there are no oral agreements or understandings between you and Gulf One Design which will be deemed to extend, restrict, or otherwise supersede the exact terms of this agreement. This Agreement, constitutes the entire agreement between the parties.
